{"id":44287,"date":"2026-09-12T03:16:42","date_gmt":"2026-09-12T03:16:42","guid":{"rendered":"https:\/\/this-is-vegan.com\/?p=44287"},"modified":"2026-09-12T03:16:58","modified_gmt":"2026-09-12T03:16:58","slug":"croatia-animal-cruelty-sentences","status":"publish","type":"post","link":"https:\/\/this-is-vegan.com\/en\/croatia-animal-cruelty-sentences\/","title":{"rendered":"Croatia moves to punish animal cruelty with up to eight years in prison"},"content":{"rendered":"<p><strong>Croatia's government wants animal cruelty to carry up to eight years in prison.<\/strong> The draft was approved by cabinet on 10 September 2026 and sent to the Sabor, the Croatian parliament, one day later. The same package contains two things that made international headlines: life imprisonment, and a new offence covering the most severe destruction of nature, which the press calls ecocide.<\/p>\n<p>One thing first, because reporting on this has been muddled. This is a <strong>bill in first reading<\/strong>, not law. Nothing has been passed, nothing has been published in the official gazette. The closing article of the draft sets the date of entry into force at <strong>1 January 2027<\/strong>, provided parliament agrees.<\/p>\n<h2>What would change for animals<\/h2>\n<p>The central provision is Article 205 of the Croatian criminal code, &#8220;killing or torturing animals&#8221;. Today it carries up to two years, or up to three if the offender acted for profit. The draft raises that sharply:<\/p>\n<ul>\n<li><strong>Six months to five years<\/strong> for severe mistreatment, inflicting unnecessary pain, or exposing an animal to unnecessary suffering.<\/li>\n<li><strong>One to eight years<\/strong> where an animal is killed without justified reason, or where the act is committed for profit.<\/li>\n<\/ul>\n<p>A new provision, Article 205.b, covers the <strong>sexual exploitation of animals<\/strong>: six months to five years, and one to eight years if the animal dies. Until now such acts could only be prosecuted under the general cruelty provision, and only where it could be shown that the act caused the animal pain. The explanatory memorandum abandons that construction on purpose, arguing that an animal cannot consent.<\/p>\n<p>A small wording change may matter most in practice. For bans on keeping animals, the word &#8220;may&#8221; is replaced by &#8220;shall&#8221;. A ban of one to five years, extended accordingly when a prison sentence is imposed, would become <strong>mandatory<\/strong> instead of discretionary, and could also be imposed on offenders found not criminally responsible.<\/p>\n<p>Prijatelji \u017eivotinja, the Croatian animal rights organisation that took part in the consultation, calls the new sexual exploitation offence the biggest step forward in this reform. Several of its demands did not make it into the government draft: a separate offence for animal fighting, criminal liability for producing and possessing abuse material, bans on keeping animals of five to ten years, and a duty to report. Photo: Adobe Stock<\/figcaption><\/figure>\n<h2>Abandoning an animal has been a crime since 2024<\/h2>\n<p>Headlines currently circulating in German-speaking media suggest that Croatia is now criminalising the abandonment of pets. That is accurate as a statement, but it describes the situation as of <strong>April 2024<\/strong>.<\/p>\n<p>An earlier amendment, in force since 2 April 2024, introduced Article 205.a: anyone who abandons a domestic animal or an animal kept under human care in order to permanently get rid of it faces up to one year in prison, and up to two years if the animal dies or if several animals are abandoned. The animal is confiscated. The current draft leaves that article untouched.<\/p>\n<p>Shelters and Croatian media estimate that <strong>more than 10,000 dogs and cats<\/strong> are abandoned in Croatia every year, peaking during the holiday season. Dumovec, the Zagreb shelter, took in around 1,200 animals in 2025 and 740 in the first half of 2026 alone. No official statistics exist, all of these figures are estimates.<\/p>\n<h2>How the neighbours compare<\/h2>\n<p>Germany, where we publish, looks worse than its reputation. Abandoning an animal is a <strong>regulatory offence<\/strong> there, not a crime: Section 3 of the Animal Welfare Act prohibits it, Section 18 sets a fine of up to 25,000 euros. It becomes a criminal matter under Section 17, punishable by up to three years, only where the animal suffers significant pain or dies as a result. A 2024 government bill that would have raised those penalties expired with the end of the parliamentary term. The amendment currently before the Bundestag deals with video surveillance in slaughterhouses and leaves the sentencing range untouched.<\/p>\n<p>Austria treats abandonment as a crime under Section 222 of its penal code, up to two years, but only where the animal is unable to survive in the wild. Switzerland is the strictest of the three: under Article 26 of its Animal Welfare Act, abandoning or leaving behind a pet is cruelty, punishable by up to three years.<\/p>\n<h2>Ecocide, and a deadline everyone missed<\/h2>\n<p>The part drawing international attention is called, soberly, &#8220;particularly serious offences against the environment&#8221;. It would cover acts that destroy an ecosystem of significant size, or the quality of air, soil, water or sea, in a way that is <strong>irreversible or long lasting<\/strong>. The penalty: at least ten years, up to long-term imprisonment, which in Croatia means 21 to 40 years. Once life imprisonment exists, that too becomes available. The offence would not be subject to any statute of limitations.<\/p>\n<p>Justice Minister Damir Habijan said on television that no EU document actually defines ecocide, and that Croatia would be among the first EU states to have such an offence on the books. For comparison he cited France, with up to ten years, and Belgium, with up to twenty. Corporate fines are to rise from 20 and 25 million euros to <strong>50 million<\/strong> under a companion bill.<\/p>\n<p>The push comes from Brussels. The reform transposes the EU directive on the protection of the environment through criminal law, which member states had to implement by <strong>21 May 2026<\/strong>. Croatia will miss that by more than seven months. Photo: Adobe Stock<\/figcaption><\/figure>\n<h2>The criticism<\/h2>\n<p>Prime Minister Andrej Plenkovi\u0107 pointed to a killing in the town of Drni\u0161 as the trigger for the reform. Defence lawyer \u0160ime Matak countered on Croatian television that a single case should not reshape a foundational statute, and that in terms of criminal policy Croatia, &#8220;a relatively safe society&#8221;, does not need penalties this harsh. Experts quoted in the same report called the reform populist. No official list exists of the 15 most serious offences that would carry life imprisonment; the text itself simply refers to offences punishable by long-term imprisonment.<\/p>\n<h2>Which animals the law protects, and which it does not<\/h2>\n<p>Everything hangs on one phrase. What is punishable is killing an animal <strong>without justified reason<\/strong> in Croatia, or without a &#8220;reasonable ground&#8221; in German law. Beating a cat to death qualifies. Slaughtering a pig does not. Same act, same capacity to suffer, entirely different legal consequences, and the difference is consumer demand.<\/p>\n<p>Germany slaughtered roughly 746 million animals in 2025, fish not included. Not one of those cases is a matter for the cruelty provisions. Article 13 of the EU treaty calls animals sentient beings, and the New York Declaration on Animal Consciousness of 2024 summarises the scientific consensus for vertebrates and many invertebrates. Tougher sentencing for cruelty is worth having, and we welcome it. It still stops at the barn door, and the 746 million are on the other side of it.<\/p>\n<h2>Sources<\/h2>\n<p>The bill &#8220;Prijedlog zakona o izmjenama i dopunama Kaznenog zakona&#8221; (P.Z.E. no. 343) was approved by the Croatian government on 10 September 2026 and introduced in the Sabor on 11 September 2026. We worked from the <a href=\"https:\/\/www.sabor.hr\/sites\/default\/files\/uploads\/sabor\/2026-09-11\/120602\/PZE_343.pdf\">full text of the bill<\/a>, the <a href=\"https:\/\/vlada.gov.hr\/za-zbrinjavanje-neopasnog-otpada-iz-gospica-rok-od-45-dana-uvodi-se-kazneno-djelo-protiv-okolisa\/47266\">government statement<\/a> and the <a href=\"https:\/\/vlada.gov.hr\/kaznenopravna-sankcija-dolazi-na-kraju-vazniji-su-prevencija-i-edukacija\/47277\">minister's television interview<\/a>. Current law: the <a href=\"https:\/\/www.zakon.hr\/z\/98\/Kazneni-zakon\">consolidated criminal code<\/a> and the <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/full\/2024_03_36_570.html\">2024 amendment<\/a>. German provisions were checked in the original at gesetze-im-internet.de, Austrian and Swiss law in the official databases. The Commission's <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/api\/files\/document\/print\/en\/inf_26_1380\/INF_26_1380_EN.pdf\">infringement package of 15 July 2026<\/a> lists the 23 member states concerned.<\/p>\n<p>Open questions: parliament has not voted, and the text may change. There is no official list of offences that would carry life imprisonment. Figures on abandoned animals come from shelters and media, not from official statistics. We do not name the accused in the Drni\u0161 case; proceedings are ongoing and the presumption of innocence applies.
