To keep the timeline straight: the ruling by the Swiss Federal Supreme Court dates from 27 March 2026<\/strong>. What is new is the implementation. Danone Switzerland announced the new name on 15 September 2026<\/strong>, which is why the story is circulating now. No fresh court decision was handed down this week.<\/p>\n<\/div>\n

For years, the oat drink from Alpro carried a small joke on its front panel: \u201eShhh\u2026 this is not milk\u201c. A wink at the dairy aisle, printed in capital letters, with a white droplet standing in for the \u201ei\u201c in milk. Switzerland's highest court has now ended the joke, and this week the packaging finally caught up.<\/p>\n

The new name went public on Tuesday<\/h2>\n

Danone Switzerland announced on 15 September that the Alpro oat drink is now called \u201eShhh\u2026 this is tasty\u201c. The company also reworked the recipe: the drink goes on sale without added sugar, which it previously contained. Isabel Petit, who runs Danone's business in Switzerland, Austria and Slovenia, summed it up in one line: \u201eThe name has changed. The taste has not.\u201c<\/p>\n

Nothing inside the carton is different. Same oats, same liquid, same product. What changed is the sentence you read while you reach for it.<\/p>\n

A droplet instead of an i, and still too close to milk<\/h2>\n

The dispute started in a Zurich supermarket. In 2022 the cantonal laboratory of Zurich banned the product from being sold with that label, arguing it could mislead shoppers, even though the back of the carton correctly said \u201eHaferdrink\u201c, German for oat drink. The Zurich administrative court backed the authority in 2024, and Danone took the case to Lausanne.<\/p>\n

On 27 March 2026 the Federal Supreme Court dismissed the appeal in a public deliberation, by four votes to one according to the Swiss news agency. The court's official statement contains the sentence that matters: \u201emilk\u201c may not be used to designate a vegan product, and that applies \u201ein principle also when the designation \u201amilk\u2018 is used as a negative claim (\u201aI am not milk\u2018) or is typographically altered\u201c.<\/p>\n

Read that again. You are not allowed to use the word even to tell people that your product is not that thing.<\/p>\n

Why the denial still counts as a claim<\/h2>\n

Swiss food law reserves the term. As the court quotes it, milk is \u201ethe product obtained by milking from the udder secretion of animals of the mammal genus\u201c. Anything that could mislead consumers about what they are buying is prohibited, and the judges looked at the packaging as a whole rather than at one clever line.<\/p>\n

There is an obvious objection, and it was raised inside the courtroom before ending up in the minority: nobody picks up a carton saying \u201ethis is not milk\u201c believing a cow was involved. The counterargument is consistency. A protected term stops being protected the moment irony is allowed to borrow it.<\/p>\n

Three rulings, one direction<\/h2>\n

Switzerland has been building this line of case law for years. In May 2025 the same court decided that plant-based meat alternatives may not carry animal species in their names, a case involving products from Planted. In July 2026 it ruled that vegan salami and vegan ham cannot be sold under those names either. The oat drink sits in the middle of that sequence, and September's rebrand is simply the moment a company implemented what was decided in spring.<\/p>\n

That distinction got lost in some headlines this week. No new ruling landed on Tuesday. What landed was a printing decision, six months after the legal one.<\/p>\n

What it means outside Switzerland<\/h2>\n

Switzerland is not an EU member and applies its own food law, so the ruling stops at the border. If you shop in the EU, though, you already live with the same outcome. \u201eMilk\u201c has been reserved for animal milk across the bloc for years, confirmed by the European Court of Justice in its 2017 TofuTown decision. That is why German supermarkets sell Haferdrink rather than Hafermilch, and why oat cartons across Europe are full of careful wording.<\/p>\n

The live question is how far the principle travels. Brussels is still arguing about whether plant-based products may be called burgers or sausages<\/a>, and Germany has floated a sugar tax that would hit plant drinks while leaving cow's milk untouched<\/a>. Naming is one front among several.<\/p>\n

Who gains from the rebrand<\/h2>\n

The dairy industry keeps its word, and that word carries decades of advertising behind it. As long as it stays exclusive, every plant-based brand has to invent its own vocabulary, which costs money and attention.<\/p>\n

Danone hardly suffers. A corporation that loses in court and responds by printing \u201ethis is tasty\u201c on its carton gets a story that even financial media pick up. That is our reading, not a fact: defeat looks cheap when you can package it as a shrug.<\/p>\n

The real weight falls elsewhere. A four-year run from an inspector's objection to the country's highest court is not something a small producer takes on. The practical effect of rulings like this is pre-emptive caution, long before any laboratory objects to anything.<\/p>\n

The part nobody litigated<\/h2>\n

Behind the vocabulary sits a production system. Cows give milk because they have given birth, which means annual insemination and, in most operations, separating the calf from its mother within hours or days. Male calves have no role in milk production and go into beef. That is how the industry works, not an accident at the margins.<\/p>\n

An oat drink needs none of it. It is a strange allocation of legal attention: a typographic droplet occupies a supreme court while the substance of the system goes unexamined.<\/p>\n

The change is documented for Switzerland, where the ruling applies. Danone has not said publicly whether packaging changes in other markets.<\/p>\n

Can I still say oat milk?<\/h3>\n

In conversation, yes. On the label, no, at least not in Switzerland or the EU, where the term is reserved for animal milk.<\/p>\n

Does the old carton have to be thrown away?<\/h3>\n

No. The objection was to the labelling, not to the food itself.<\/p>\n

Is the drink healthier now that the sugar is gone?<\/h3>\n

The sugar was removed in a parallel recipe change, according to Danone, not because of the ruling. A single nutrient does not decide whether a product suits you.<\/p>\n
